The Underhill Workshop series seeks to help businesses learn what questions they should be asking. If you don’t know what questions to ask, you may not see danger coming. Far too many businesses, especially closely held, smaller, or growing businesses, think of legal advice as a luxury they cannot afford. This is not true and can be very dangerous. If you have set up your business and written your contracts without legal advice, you may be setting yourself up for a messy fight, regulatory action, or worse. Whether your industry is highly-regulated, like Colorado’s marijuana industry, or more old fashioned, like a construction contractor, there are myriad laws and rules that control your behavior.
The time will come in every businesses’ life when it runs into a legal problem. Perhaps a customer refuses to pay the bill or accuses your business of defective work. Perhaps a subcontractor has not performed as agreed. Perhaps a shareholder or member of your company wishes to separate. Or, maybe you end up on the other side of any of these issues, damaged by a contractor or frozen out of a business you helped grow. In these situations, one of the most important factors controlling how well the dispute will go is how well you prepared for it beforehand. The more educated you are, the better your chances will be of ensuring justice is done!
